Google Cloud Connector – Terms of Service
Please read these Terms of Service (“Agreement”) carefully. This is a legal agreement between you, an individual or legal entity (“You”), and Marketing Decisions Pty Ltd (“We” or “Us”), regarding the use and implementation of the Marketing Decisions Google Custom Audience Connector (“the Service”). By using the Service,
you agree to abide by this Agreement. If you do not agree to this Agreement, then do not use the Service.
DEFINITIONS
“Account” means your password-protected account through which you use the Service. An Account is intended to represent the legal entity using the Service. “Your Content and Data” means any electronic data, information, or material captured and stored by the Service as a result of your use of the Service. “Sensitive Data” is data that, if disclosed without authorization, could result in significant economic, reputational, or privacy harm to the data subject, as defined in applicable data privacy rules and regulations.
PRODUCT AND SERVICE DESCRIPTIONS
The Marketing Decisions Google Custom Audience Connector facilitates integration between Client’s Oracle Marketing Cloud (Eloqua) and their configured Google Ads account to perform Add, Remove or Refresh operations on already existing customer match lists. The application serves as a One way integration where First party user data existing in client’s CRM is exported to Customer match lists inside their Google Ads account with respect to their configuration. The application uses Google Ads SDK and adheres to Google APIs Terms of Service.
YOUR ACKNOWLEDGMENTS AND RESPONSIBILITIES AS A USER
You acknowledge that as part of, and included in the Service, we use certain technology, software, hardware, products, processes, algorithms, user interfaces, know-how and other trade secrets, techniques, designs, inventions and other tangible or intangible technical material or information owned or licensed by us. You represent and warrant that you will comply with all applicable local, state, national, and foreign laws, treaties, and regulations in connection with your use and access of the Service. You will be responsible for all activities that occur under your Account and will use commercially reasonable efforts to prevent unauthorized access to, or use of, the Service.

INTELLECTUAL PROPERTY RIGHTS
You acknowledge that Marketing Decisions Pty Ltd owns all right, title and interest in and to the Service, including without limitation all intellectual property rights, and such rights are protected by Australian and international intellectual property laws.
SENSITIVE DATA
You represent and warrant that you will not use the Service to input, collect, or store sensitive data. Sensitive data includes, but is not limited to, credit card numbers, bank account numbers, social security numbers, passwords, security challenge information, sensitive health information classified as confidential under the Health Insurance Portability and Accountability Act (“HIPAA”), and drivers license numbers. Protection of Sensitive Data in Transit: Any Sensitive Data sent to or from the Service is be transmitted via SSL connection. We use industry standard SSL ciphers to ensure Sensitive Data is protected while in transit.
TECHNICAL UPDATES
We may occasionally make updates or modifications to the Service. We will exercise reasonable efforts to provide advance notice of any significant updates.
LIMITATION OF LIABILITY
You expressly understand and agree that we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if we have been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.
